Who Can Help Realtors With 2026 FinCen Regulations
FinCEN is a Financial Crimes Enforcement Network, which is a bureau in the U.S. Department of the Treasury that enforces financial regulations to prevent financial crimes.
As of March 6, 2026, certain property transfers must be reported nationwide. The reporting requirements apply to non-financed residential property transfers to trusts or legal entities. While this requirement is aimed at residential properties, it also includes some vacant land or commercial properties. The goal of this regulation is to increase transparency in residential real estate.
Families transferring properties to a child or family trust is one area where many people have questions and concerns. Transfers directly to a person are not required to be reported, but property transfers to an entity like a family trust are likely subject to the requirements. It’s best to have a title company involved in your transaction plans so that you conduct the transfer correctly.
Civil penalties and fines can occur for neglecting this requirement. Reports must be submitted by the latter of two options— 30 days after the transfer or the last day of the month of the transfer—through the BSA E-Filing System.
