The importance of working with an established and reputable title company was recently highlighted by a story covered by WTSP 10 News about a Clearwater homeowner who faces serious financial consequences because of failure to obtain the proper permits for her swimming pool.
A Problem Decades in the Making
When Janet Martin purchased her home 16 years ago, the title company she chose found no issues with the property. It was not until quite recently, however, that Martin was made aware that the original owner had not obtained the proper permits for the pool in 1980. This left Martin on the hook for bringing the pool up to code, for a complete electrical inspection for the installation and for fines associated with the enforcement of these codes.
No Real Recourse
Martin has been in touch with Pinellas County Code Enforcement regarding the violations reported for her property. Unfortunately, the issues must be resolved to allow the sale of the home. The title company that handled Martin’s sale went out of business in the intervening years since her purchase of the home. While the original owners might also be liable for Martin’s financial costs, they cannot be located at this time.
